Code Enforcement Officer

Code Enforcement is the prevention, detection, investigation and enforcement of violations of statutes or ordinances regulating public health, safety, and welfare, public works, business activities, and consumer protection, building standards, land-use, or municipal affairs.

Here at the Code Enforcement office, we strive for a clean, safe place for you to call home.  We are not here to inconvenience or make life difficult, but to improve the town, property values, and the overall safety of our Borough.

If you plan to make repairs, additions or remodel your home, please check with the Code Enforcement Officer to see if permits will be required.  You may also have to Contact our Third Party Inspections Services Office to see if permits are required.  If you do not get a permit when one is required you may have to pay double the cost.
Please feel free to contact Jason at BHW Inspection Services 570-704-9478 if you have any questions, prior to doing any work.  Home improvement contractors must register with the Attorney General's Office.  Before you hire a contractor ask for his registration number and insurance information.  Also if you need a Zoning permit you must contact the Luzerne County Zoning Office at 570-826-1501.

If you have a concern or complaint, we ask all complaints be filed in writing on our complaint form.  Please include your name and contact information  as we may need to speak to you.  your information will be kept confidential, and help us better evaluate any possible violations.  Anonymous complaints cannot be accepted.

Grass and weeds must be maintained no higher than 6 inches at all times.  Grass clippings, leaves and yard waste are collected for recycling by the Borough and cannot be swept or blown into the streets, sidewalks or storm drains.  Storm drains lead to our waterways and keep the streets free of flooding.  Please help us to keep our streets and waterways clean and refer to your recycling calendar for pick up dates.

Snow and Ice must be cleared from sidewalks after the end of a snowfall.  Please do not shovel or blow snow onto streets.

Tenant registration forms are required to be updated whenever a change of tenant occurs within 30 days.  If you own a rental property and have not submitted a tenant registration form, please contact the Code Enforcement Office.  If you are a renter and are not sure your dwelling has been registered, please check with your landlord or the code enforcement office.

Please visit the Borough website to view our Ordinances, complete any applications for building or zoning permits, or complaint forms.  If the application or information needed is not present, please contact our office for assistance.


Ordinance Reminders:


1.  Yard Maintenance - No storage of trash items, Keep lawns, trees and bushes trimmed and maintained.

2.  Dog Ordinance - Leash required.  Clean up after pets when walking your pets.  No pets permitted in the playground area.

3.  Health and Sanitation Ordinance - Refuse and Recycling Mandatory.   Trash and recycling out the day before collection.

4.  Nuisance Ordinance. -

5.  Burning Ordinance. - No open burning or burning of leaves, trash permitted.

6.  No Parking Ban During Winter Snow Storms - After snowfall of 3" or more no parking on even side of street the first day after snowfall and No Parking on Odd side the second day after snowfall. 

7.  Sidewalks must be cleared within 48 hours of snowfall.

Ordinance 8,9, 10 will be discussed at July 12, 2016 meeting to increase fees for violation.   Ordinance on tenant registration was increased at the June meeting of Council.  Councilwoman Pina Hansen is working on updating ordinances and the fines for violation with Borough Solicitor Erik Dingle.

snow ordinance - 94-02 of 1994

After snowfall of three inches or more: By 7 am it will be unlawfull for any person to park a vehicle on designated sides of strees..  From 7 am to 5 pm on the first day after the snowfall there will be no parking on the EVEN numbered side of the streets to facilitate clearing of snow.  The following day the ODD numbered side o the street will be designated as a no parking zone for clearing of snow.  VEHICLES NOT REMOVED ON DESIGNATED DAYS FOR SNOW REMOVAL WILL BE TICKETED AND TOWED AT OWNERS EXPENSE.

ALSO EVERYONE IS REQUIRED TO CLEAN THEIR SIDEWALKS OF SNOW WITHIN 48 HOURS FOLLOWING THE END OF THE SNOWFALL.     IT WILL BE ILLEGAL FOR ANYONE TO THROW SNOW ONTO THE ROADWAY WHEN CLEARING DRIVEWAYS OR SIDEWALKS.

ANYONE HIRING A PRIVATE CONTRACTOR TO REMOVE SNOW IS RESPONSIBLE FOR PLACING ALL SNOW ONTO PRIVATE PROPERTY.  PILING OF SNOW AT INTERSECTIONS IS NOT PERMITTED.


CODE ENFORCEMENT:
Dupont Councilwoman Pina Hansen works with Officer Jennifer Polemitis to enforce the borough ordinances in place to protect the residents of the community including yard maintenance, burning, dog, nuisance, health and sanitation, delinquent accounts  and much more.  If you have a complaint, please call or email dupont borough.  Councilwoman Pina Hansen  will investigate; She will carry a name tag and also her vehicle will be marked with code enforcement so as to avoid problems when doing site visits.  She then will address the complaints with notices and copies of the ordinances that pertain to the complaints.   The Borough Solicitor will work with Officer Polemitis and Councilwoman Pina Hansen at the court hearings .


PERMITS REQUIRED FOR ALL HOME REMODELING PROJECTS

Zoning permits required for new construction, additions, garages, carports, sheds, decks, pools, and any accessory structures; changes in property or structure uses and business uses and signs.  Information required to obtain zoning permit: name, address, phone of owner, pin number of property, drawing of work to be done including distances to property lines on drawing, copy of sewer permit for new home and check payable to Luz. Co. Planning Commission.  Office for permit is Penn Place Building, Wilkes-Barre.  Phone is 825-1560.
Building permits required for all remodeling projects large or small, interior or exterior such as sidewalks, driveways, windows, insulation, roofs, bathrooms, cabinets, electric, heating, plumbing, and much more.  Contact BHW Construction Consultants in Plains in the Dolphin Plaza @ 570-704-9478.  Work without a permit  stops the job and doubles the permit fee,not to mention possibly a daily fine of $1000 for non compliance.
